Gramakantha Porambok land, homestead less & Agriculture lease and issue of Pattas to the beneficiaries
under flagship programmes/schemes under Revenue Administration.

Sir,
With reference to the letter
on the subject cited above, I am to say that, it has come to the notice of the
Collector, Nabarangpur that issue of pattas to the beneficiaries under Grama
Kantha Poramboke scheme, homestead less lease & Agriculture lease has been
withheld on the plea of commencement of Settlement Operation in some villages.
In this connection, I am
to say that as per discussion made with the Collector; Nabarangpur on
19.2.2013, the following clarifications are hereby issued, which should be
followed scrupulously.
1.
The A.S.O in the Rent camp is not vested with
powers to settle Grama Kantha Porambok land in favour of any person under
O.G,L.S. (Amendment) Rules,2010. It is only the Tahsildar, who is competent to
settle such land basing on the Sabik record or Hal record available with Tahsil
after making necessary verification on receipt of applications from the eligible
beneficiaries. It is very clearly spelt out in the Notification
No.5374/R&DM dated 11.02.2010 of Government in Revenue & Disaster
Management Department, Odisha that the Tahsildars are to settle land having character
of Grama Kantha Poramboke in favour of the persons who have constructed house
over the said land prior to 26th
February,2006 and used for homestead purpose.

There is no such inhibition to settle Government
land in favour of landless persons or to grant lease in a Revenue village where
notification for Survey & Settlement operation is made as per provision
3(A) of Odisha Survey & Settlement Act. The restriction imposed relates to disposal
of mutation and updation of Revenue records, but nowhere, it is mentioned that
Government land can also be covered under this blanket of fog.

It is construed that this restriction is
applicable to Mutation cases and updation of Revenue records relating to Rayat
land. But, in case of land recorded in Government Khata, there is no such
specific deterrence. Tahsildars are empowered to settle Government land under
O.G.L.S. Act and Rules in favour of eligible persons in order to complete such
flagship programmes of Government in letter and spirit. Government have
launched these programmes to settle land under O.G.L.S Rules / G.K.P.Scheme for
the benefit of eligible persons realising the importance, need and advantage
that the people can derive from it. As such, it is not prudent to withhold
settlement of Government land under Gramakantha Porambok Scheme/OGLS Rules, making
a misconception of the Notification issued
reviving the Survey & Settlement Operation vide No.31920/RDM dated
28.7.2008 of Government in Revenue & Disaster Management Department,
Odisha.

If Grama kantha Poramboke land is settled in a
Revenue village where notification for Survey & Settlement Operation is
made as per the provisions of law envisaged in the O.G.L.S. Rules, 1983 and
subsequent amendments thereof, it does not amount to infraction of any Rules
and commission of procedural errors.

You are aware that Mutation and Updation of Revenue records are made in respect of Rayat
Land in general law. But, land recorded in Government Khata is not subject to mutation.
It can be given on lease by way of settlement in favour of landless persons/
homestead less persons or anybody whomsoever, the Government feel eligible to
get.

As such, to settle the Government land under
Grama kantha Porambok Scheme in accordance with the provision of
O.G.L.S(Amendment) Rules, 2010, even in
the Revenue village where Survey & Settlement operation is launched is not
an act of contravention, as the spirit behind the Flagship programme of
Government, is to provide homestead patta to the eligible persons as per their
possession of land to the extent permissible.
In
view of the facts enumerated above, you are requested to settle the Grama
Kantha Poramboke, homestead lease, agriculture lease under OGLS Act & Rules
exercising your power vested with you and issue pattas as well as physical
possession of land to the beneficiaries by the end of February,2013 under intimation to Settlement Authorities
without hanging in tenterhooks.
Further,
you are once again requested to provide details of Sabik khata no., Sabik Plot
No. and trace map with names of such beneficiaries to whom such land as settled
to the Settlement Office to initiate Misc. cases for necessary correction for
corresponding plots during preparation of final ROR of that village mentioning the
number of Hal Khata and Plots.
A
line of compliance on the matter may be reported on or before 1.3.2013 for kind
perusal of Collector, Nabarangpur.
